1. About these terms

Puff Studio (puff.land) is a tool for designing what plays on a Puff. It’s run by Noware Devices Inc. (“Noware”, “we”). By using Puff Studio you agree to these terms and to how we handle data as described in our Privacy & Data Use page.

2. Your designs are yours

You own the designs you make in Puff Studio, including anything you generate with the AI assistant. We don’t claim ownership of them, and we don’t use them to train AI.

To run the service we need a few limited permissions, and only these:

• to store your designs and send them to your Puff;
• if you share a design’s link, to show it to the people who open that link;
• if you make a design public, to show it on Explore, let others install and remix it, and feature it, including images and videos of it running on a Puff, on Puff Studio and in Noware’s own posts, social media and promotion, credited to you where practical. We don’t feature private or unlisted designs;
• these permissions end when you unpublish or delete a design, except for copies other people already installed or remixed and posts we already published.

To do those things, you give Noware a worldwide, non-exclusive, royalty-free licence to host, store, copy, display and distribute your designs, only as needed for the uses listed above. This licence doesn’t transfer ownership, and you can still use your designs however you like.

3. What you bring in

Only bring in photos, videos, artwork and code that you made or have permission to use. You’re responsible for what you upload, publish and share. We don’t keep the files you upload; see Privacy & Data Use.

4. AI is optional

You can use every part of Puff Studio without AI. If you use the AI assistant, your requests are processed by Anthropic’s Claude models and are also subject to Anthropic’s Usage Policy. AI output can be wrong or look like existing work, so check what it makes before you publish it. AI features may be limited, changed or switched off.

5. Community rules

When you publish or share designs, don’t:

• post anything illegal, hateful, sexually explicit, harassing or that infringes someone else’s rights;
• post fast-flashing designs without the photosensitivity warning;
• try to break, overload or get around the limits of the service, its AI or its voting;
• write code meant to harm a Puff or the people using one.

We may hide or remove designs and suspend accounts that break these rules. You can report a design from Explore.

6. Your Puff and firmware

Puff Studio can install designs on your Puff and update its firmware. Keep it plugged in while that happens. You install designs and firmware updates at your own risk, and designs made by other people aren’t checked by us before you install them. Your Puff’s hardware warranty is covered by the terms you bought it under; these terms don’t change it.

7. The service as it is

Puff Studio is provided “as is” and “as available”. It may change, have bugs or be unavailable, so keep your own copies of anything you can’t lose. To the fullest extent the law allows, Noware gives no warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement.

To the fullest extent the law allows, Noware isn’t liable for indirect, incidental, special, consequential or punitive damages, or for lost data, profits or goodwill, arising from Puff Studio, and our total liability for any claim about it is limited to US$100. Some places don’t allow these limits, and nothing here takes away rights you have under consumer law that can’t be waived.

8. Accounts and ending things

You must be 13 or older to use Puff Studio, and if you’re under the age of digital consent where you live, you need a parent or guardian’s permission. You can stop using Puff Studio at any time and ask us to delete your account. We may suspend or end your access if you break these terms or to protect Puff Studio or other people, and we may change or discontinue the service. Sections 2 (for designs already shared), 7 and 9 continue to apply after your access ends.

9. Changes and law

If we make a meaningful change to these terms, we’ll update this page and the date at the top; using Puff Studio after that means you accept the new terms.

These terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law rules. Any dispute goes to the state or federal courts in New York County, New York, unless the consumer law where you live gives you the right to bring it locally. If a part of these terms can’t be enforced, the rest still applies.
